We are working on the basis of the German Freight Forwarders’ Standard Terms and Conditions (ADSp) and – as far as they are not applicable for the supply of logistic services – on the basis of the General Terms and Conditions of logistics-services providers – AGB in its latest edition. 

The ADSp limit in paragraph 23 the legal liability for damage to goods as per § 431 of the German Commercial Code (HGB) in the case of damage to goods whilst in the care of a forwarder to 5 EURO per kg. In case of multimodal transports – including sea transport – the liability is limited to 2 SDR (special drawing rights) per kg. In addition in case of any claim the liability of the forwarder is limited to 1 mio. EURO per damage resp. to 2 mio. EURO per event or 2 SDR per kg, whichever is the greater. 

In paragraph 14 of the General terms and conditions of logistics-services providers (AGB) the liability is limited to 20.000 EURO per claim or to 100.000 EURO for series claims as well as to a maximum of 500.000 EURO for all damages occurring within one year.
